Leaving a job without serving notice period: what to do now
You stopped working before completing your notice period. HR now says you will be marked absconding, must pay money or face legal action. Instead of switching off your phone or inventing a new explanation, collect your appointment letter, resignation correspondence and last-working-day records. The practical dispute often concerns money, handover and exit status; start addressing those issues in writing.
An ordinary failure to complete notice is generally a contractual/employment dispute, not automatically a criminal offence. A company cannot itself send you to prison. However, a notice-pay demand, disciplinary exit record, BGV questions or delayed documents may follow. Separate allegations involving theft, fraud, company funds or misuse of confidential data require a different legal assessment.
What to do today
- Read the appointment letter, contract, applicable policies and any bond.
- Prepare your attendance/resignation chronology and a list of pending handover items.
- Ask HR in writing how to regularise the exit and obtain an itemised statement.
- Return company assets by the approved method and retain a serial-numbered receipt.
- Give the next employer truthful dates and organise genuine employment proofs.

Absconding, resignation and short notice are different
In an employer’s policy, absconding often describes continued absence without information or approval. It is an HR label, not automatic proof of a criminal offence. Resigning in writing but serving less notice is different from disappearing without communication. Ask for your exit status to be reviewed against the actual correspondence, attendance and applicable policy.
If you already stopped attending, write an accurate account using today’s date. Do not backdate a resignation. State when you last worked, when and how you informed the company, and what work or assets remain outstanding. Mention a verbal discussion accurately, but do not claim approval without a record supporting it.
Illness, a family emergency, harassment or unpaid wages may be relevant. Provide appropriate evidence and request a waiver or early release. A reason does not automatically cancel every contractual obligation. Share medical information only to the extent necessary with the appropriate official; it need not be circulated widely.
Can the company sue or send you to jail?
A simple notice-period breach should not be treated as a criminal offence merely because HR uses that language. Depending on the terms and applicable law, an employer may demand notice pay or lawful compensation and attempt an appropriate civil or arbitration remedy. The forum, claim and enforceability depend on the contract and employment category. Do not rely on unsupported claims that smaller employers never take legal action.
A separate incident involving stolen property, retained company funds, forged records or data misuse can lead to a different complaint and investigation. It would therefore be wrong to say that police can never become involved. An HR warning, a lawyer’s demand notice and a court summons are different documents. Do not ignore a genuine legal notice or court process.
Preserve threatening messages and note call dates/numbers. Ask for the alleged breach, claimed amount and supporting basis in writing. Do not sign a blank undertaking or broad admission just to stop calls. If there is a concrete criminal allegation, seek assistance with the records of that allegation instead of adapting a general notice-pay template.
Check notice pay and employment-bond claims separately
Identify the notice length, any probation-specific terms, who can exercise payment in lieu, and who may approve a waiver. Offering money does not necessarily establish that a resignation has been accepted immediately. Obtain written clarity on notice buyout, early release and acceptance rather than assuming they are interchangeable.
For example, a contract may require 30 days and you may have served 10. The employer might claim a 20-day shortfall, but the salary base must still be checked. Is it basic, gross or another defined amount? Do not automatically divide CTC by 30. Ask for the contractual clause, days, salary components, deductions and proposed adjustments in an itemised calculation.
Sections 73 and 74 of the Indian Contract Act address compensation for breach and stipulated amounts or penalties. A large amount written into a contract is not automatically the amount recoverable without scrutiny; compensation and enforceability can be examined. Equally, assuming that every employment bond is invalid is unsafe.
In Vijaya Bank v. Prashant B Narnaware, 2025 INSC 691, the Supreme Court upheld the particular clause requiring ₹2 lakh if the employee left before three years. The decision does not validate every employer’s bond; its facts mattered. A minimum-service/training bond and notice shortfall may be separate claims. Request the basis and calculation for each.
Ask HR to regularise the exit with a concrete proposal
Send one calm email stating your employee ID, last actual working day and genuine reason. Ask for the process covering handover, asset return, notice shortfall, final settlement and documents. Propose a waiver, shorter notice, limited remote handover or negotiated settlement where appropriate. Obtain written confirmation before relying on a new agreement.
List the laptop, charger, access card and other property with serial numbers. Use the employer’s approved return method and obtain a receipt. Do not copy business records to a personal drive as supposed employment proof. Retain only your lawful personal employment documents and agree with HR/IT how business access and records will be handed back or removed.
Email to HR after leaving with short notice
Subject: Employee ID ___ — exit regularisation and pending formalities Dear Sir/Madam, I joined on [date] and last worked on [date]. I informed the company of my situation/resignation on [date/method, only if true]. Due to [brief genuine reason], I could not complete the full notice period. I wish to complete the exit formalities. Please provide the notice-shortfall clause and calculation, asset-return process, pending handover requirements and itemised full-and-final statement. Kindly consider [waiver/early release/appropriate settlement]. I hold these company assets: ___. Please confirm the approved return method and receipt process. Please confirm the recorded exit date/status and the process for applicable relieving/experience/service documents. Name/employee ID/contact: ___
Being willing to regularise the exit is different from accepting every amount claimed. Review the calculation before acknowledging liability for an unspecified sum. If paying an agreed amount, use an official company channel, retain a receipt and clarify the agreed effect on exit status and document issuance.
No experience letter: how to explain the issue in BGV
Before joining, tell the next employer the actual position: whether you resigned, how much notice you served, what remains disputed and which records are available. An offer may be conditional. Ask its recruiter/HR in writing whether alternative documents are acceptable. Another organisation’s practice cannot guarantee acceptance in your case.
- Genuine offer/appointment letter and relevant employee-ID record.
- Salary slips and bank records limited to necessary salary credits.
- Form 16 or other applicable employment-related tax records, if available.
- EPFO service history/passbook where provident-fund membership applied.
- Resignation correspondence, acknowledgment, handover and asset-return receipt.
- An appropriate manager/HR reference with consent and in accordance with company policy.
A PF passbook supports the contribution record; it is not a relieving letter or conduct certificate. Contributions can appear with a delay, and lack of PF does not automatically mean employment was fake. Check recorded dates and use official correction processes for errors. Do not share UAN passwords or OTPs, and provide only the documents actually needed through a verified BGV channel.
Truthful BGV explanation for the next employer
I worked at [company] as [role] from [joining date] to [last actual working date]. Due to [genuine reason], I could not complete the full notice period. The exit-formality/notice-pay issue is currently [accurate status]. I have taken these steps: [actual actions]. I can provide the appointment letter, salary records, [PF records if applicable] and resignation/asset-return correspondence. Please tell me which alternative proofs and clarification your BGV policy requires. I wish to provide accurate records.
Do not produce a fake experience letter, alter a payslip or conceal employment dates. If the former employer reports incorrect facts, ask the recruiter to identify the discrepancy and supply a factual response with evidence. Explain what happened behind an absconding label rather than assuming it can be hidden. Answer the new employer’s forms and questions truthfully.
When salary, final settlement or documents remain pending
Request separate figures for earned wages, leave-related dues, reimbursements and the employer’s claimed deductions. There is no blanket rule allowing every employer to deduct all pending money. Applicable state law, wage rules, employment category and contract need to be considered. Government service and some regulated roles may have separate resignation and acceptance rules.
If the initial representation receives no response, follow up through the HR head or available grievance channel. Access to a labour authority for wages or service-document entitlements depends on your role and applicable law; not every managerial employee has the same forum. Civil or arbitration routes may also be relevant. Respond to an actual legal notice on time using the facts and applicable terms.
Advice
Keep an accurate chronology, proof of asset return and written confirmation of calculations. Maintain safe official correspondence instead of disappearing again. Do not create misleading exit dates or undisclosed employment overlaps. If workplace harassment or misconduct is involved, preserve those records and use the appropriate complaint route separately.

FAQ: leaving a job without notice period
Does short notice automatically mean jail?
An ordinary contractual shortfall is not automatically a criminal offence. Separate allegations of an offence require a separate assessment.
Must I always pay notice pay?
Check the contract, applicable rules, waiver and circumstances. Ask for the clause and itemised calculation first.
Will a PF passbook guarantee the next job?
No. It may support employment verification, but the next employer decides which records satisfy its BGV and joining requirements.
Can I leave probation without any notice?
Probation terms may differ, but zero notice is not automatic. Check your appointment letter and applicable rules.
Do I need to return the company laptop?
Return company property through the approved process and obtain acknowledgment. Holding or selling it over a salary dispute can create a separate problem.
