Resignation and removal are not the same
The street wants Gyanesh Kumar to resign. Resignation is leaving. Removal is Parliament’s path. Article 324 vests superintendence of elections in the Commission. Article 324(5) says the CEC is removed in the manner and on the grounds of a Supreme Court judge. The grounds are proved misbehaviour or incapacity. Ordinary anger is not a ground.
The Hindu and LiveMint explained this in September 2026 as the removal demand grew. The 2023 appointment law also records judge-like protection. Other Election Commissioners are not removed except on the CEC’s recommendation. Gyanesh Kumar is the CEC, so the judge-like path applies.
The steps in Parliament
A motion may start in either House. Admission needs at least 100 Lok Sabha signatures and 50 in the Rajya Sabha, on the judge-removal model. An inquiry committee follows. The motion must pass by a two-thirds majority of members present and voting in both Houses. The President then orders removal. It is a long path. A crowd date does not shorten it.
A completed impeachment that actually removed a CEC is not the familiar precedent in this row. The demand is new. The procedure is old.
Arrest is a different question
Some slogans mention arrest. Arrest of a constitutional office has separate legal knots. This article is about parliamentary removal. No arrest fact existed by 3 October.

Can the opposition remove him alone?
No. A special majority in both Houses is required. The opposition does not have that number by default.
Can the President remove him directly?
Not before the procedure. The order follows Parliament’s motion.
Who accepts a resignation?
The office-holder resigns. Anyone can demand it. A demand is not a resignation.

Before you type impeachment, remember 100 and 50 signatures, then two-thirds. This is not tomorrow morning’s result. Resignation is a different door, a personal decision. If you understand the procedure you will forward fewer rumours. The protection exists so an election officer is not moved by daily pressure. Pressure and procedure are both real. Do not merge them.
