Landlord Overcharging for Electricity? Sub-Meter Bills and Tenant Complaints

Landlord Overcharging for Electricity? Sub-Meter Bills and Tenant Complaints

Landlord overcharging for electricity? Start with the actual bill

You agreed on the room rent, but at month-end the landlord asks for ₹1,800 for 150 sub-meter units at ₹12 each. There is no copy of the main electricity bill, only an explanation that this is the building’s rate. Before paying blindly or threatening criminal action, obtain the calculation and check the rules governing that connection.

If your landlord is overcharging for electricity, ask for the actual DISCOM bill, sub-meter readings and a charge breakdown. India does not have one universal legal electricity rate for tenants. Whether a demand is permissible depends on the state tariff, connection category, authorised supply arrangement and documented charges.

₹10–12 per unit: distinguish billing costs from an unsupported demand

An electricity bill can include more than energy charges. Fixed charges, applicable surcharges, electricity duty, the billing period and subsidy can affect the amount. Several occupants using a main connection can also produce a different slab outcome from separate connections. The lowest slab rate is not necessarily the final rate for every unit consumed.

However, saying “everyone here pays ₹12” does not establish the correctness of that charge. Ask whether maintenance, a common water pump or backup power is included, and what evidence and contractual basis support those items. Check for duplicate recovery: an expense may already be included in the unit rate and then charged again separately. Electricity and other services should be identified clearly.

Read the sanctioned use and tariff category on the main bill. Domestic supply, commercial use and group housing or single-point supply can involve different arrangements. A high charge does not itself prove commercial classification. Letting out a home does not justify assuming an automatic commercial category without examining the applicable rules.

How to audit the main bill and your sub-meter

Collect the complete main bill, consumer number, billing dates and main-meter consumption. Record your sub-meter number, opening and closing readings, rental agreement and earlier payment receipts. Take photographs from a safe distance; do not open seals or wiring.

If the opening reading is 2,300 and the closing reading is 2,450, usage is 150 units. At ₹12 per unit the demand is ₹1,800. Compare it with the relevant main bill for the same period. A reading for one calendar month cannot be matched mechanically with a main bill covering a different or two-month period.

Item Question to ask
Energy charge Which tariff and slabs apply?
Fixed and other charges What is the actual expense and how is my share calculated?
Subsidy or adjustment How is any bill credit reflected in allocation?
Common use or backup What service, evidence and allocation basis support this amount?
Arrears or late fee Which period does this cover and why is it assigned to me?

For illustration, suppose the main connection records 600 units and ₹4,200 of documented costs eligible to be shared for the same period. The average is ₹7 per unit, producing a proportional figure of ₹1,050 for 150 units. This is an audit example, not a statutory tariff or compulsory allocation formula. Separate old arrears, deposits, penalties and other services first. Local rules and the arrangement may require a different allocation of fixed charges or common consumption.

If subsidy reduces the payable bill to a low amount or zero, do not automatically declare every occupant’s liability zero without checking entitlement and cost-sharing rules. Equally, credits, refunds or subsidies should not be concealed to inflate the claimed expense. Transparent arithmetic is the starting point.

The rate must be assessed against the tariff and authorised supply arrangement.

Does a sub-meter or agreement make a higher rate lawful?

A private sub-meter is not automatically an independent DISCOM connection. It may measure your usage downstream of the main supply. Whether the sharing arrangement is authorised, and what cost recovery is permitted, depends on local rules and connection terms. Sharing actual expenses, charging an unsupported markup and providing unauthorised supply are different issues. Examine permissions and exceptions before alleging a licensing violation.

If your agreement specifies ₹12 per unit, include the clause with any complaint. An agreement does not override applicable electricity rules, but the clause cannot responsibly be declared automatically void without reviewing those rules and facts. If the agreement says “actual bill” while a fixed markup is demanded, identify that discrepancy clearly.

A PG, hostel or serviced accommodation may bundle several services with rent. Do not assume it has the same arrangement as an ordinary rented flat. For a new tenancy, agree in advance on a separate DISCOM meter or a transparent sharing method, reading dates and payment receipts.

Send a written request, then choose the right complaint route

1. Ask the landlord for the calculation

For [start date] to [end date], my sub-meter readings are [opening] and [closing], showing [units] consumed. Your demand is ₹[amount]. Please provide the corresponding main DISCOM bill, applicable tariff/category and separate energy, fixed, surcharge and other charges. Please explain my allocated share and the relevant agreement clause. If the calculation shows an excess, I would like to discuss an adjustment or refund.

Preserve the reply, screenshots, payment references and acknowledgment. You can request a reasonable response period, such as seven days, without presenting it as a nationwide legal deadline. A month-by-month record of readings and demands is more useful than repeated verbal arguments.

2. Ask the DISCOM about tariff and the supply arrangement

Use the official complaint channel or subdivision office of the distribution company identified on the bill. Ask which category applies to the consumer number, which rules govern private sub-meter sharing and who can examine the recovery described. If you have a genuine concern about meter faults, unsafe wiring or an unauthorised extension, explain the facts. Do not label an ordinary accounting disagreement electricity theft without evidence.

Testing a DISCOM meter and examining a landlord’s private sub-meter may involve different services. Ask who can test the latter and under what procedure. A private technician’s opinion is not automatically a statutory assessment. If an assessment or theft notice has already been issued, read our guide to Sections 126 and 135, theft allegations and appeals.

3. Understand CGRF and the Electricity Ombudsman

For a DISCOM billing, connection or service grievance, the applicable process can lead from the company’s complaint system to a Consumer Grievance Redressal Forum (CGRF), then to the Electricity Ombudsman where the regulations permit. Check local rules for consumer/occupier eligibility, prior complaints, deadlines and subject-matter jurisdiction. If the main account is in the landlord’s name, explain your tenant or occupier position with documents.

Do not assume CGRF can decide every private landlord refund claim. A dispute solely about contractual recovery by a landlord may require assessment under local rent law, the applicable rent authority/controller, civil remedies or a relevant service-related consumer remedy. Every tenancy dispute does not automatically qualify for a consumer commission case.

The State Electricity Regulatory Commission issues tariffs and regulations; it is not necessarily the first forum for every individual grievance. This government consumer rights overview explains the DISCOM and grievance framework. In Madhya Pradesh, consult MPERC tariff orders and its Electricity Ombudsman information. These are MP sources and cannot simply be applied to another state.

Disconnection threats, separate connections and refunds

If the landlord threatens to cut supply or remove you after you request the bill, preserve dated messages and evidence of what happened. Depending on local rent law and your tenancy, the appropriate authority or court may be able to consider restoration of an essential service or interim relief. Seek police assistance for serious threats or violence. Reconnecting wires yourself, breaking seals or bypassing a meter is not a lawful or safe solution.

An occupier may have a route to apply for a separate electricity connection, subject to documents, lawful occupation, load and applicable formalities. Neither “every tenant always needs an NOC” nor “no tenant ever needs an NOC” is a safe nationwide rule. Obtain any written deficiency or refusal and examine the relevant rules before challenging it.

For a refund, prepare a monthly calculation of the alleged excess, payment evidence and the legal or contractual basis. Simply withholding rent or deducting electricity charges from a deposit yourself can create a further tenancy dispute. Maintain a lawful payment arrangement while recording an objection to the disputed amount and seeking appropriate relief.

If your deposit is also being withheld, see our security deposit recovery guide. Eligible tenants can seek help through NALSA or local legal services. The national legal aid helpline is 15100.

Frequently asked questions

Is charging ₹12 per unit always unlawful?

No conclusion follows from the number alone. Check the actual tariff, bill breakdown, agreement and local supply rules.

Can I complain if the agreement specifies the rate?

Yes. Provide the clause and actual charges; validity must be examined under applicable rules and facts.

Will an anonymous report guarantee a refund and uninterrupted supply?

No. Anonymous reporting depends on local policy. Personal relief or a refund can require identity and supporting documents.

Will a complaint automatically trigger a commercial-tariff penalty?

No. Any violation depends on sanctioned use, inspection and the applicable assessment process.

What if my sub-meter seems too fast?

Record readings and usage, and ask about an appropriate testing procedure. Do not tamper with the meter or equipment.

Our advice

Obtain the main bill, align the reading period, request the breakdown, record an objection and use the correct forum. Do not infer unlawful profit without the calculation, or accept an unsupported demand merely because an agreement exists. Whether the problem concerns DISCOM billing or private rent recovery will determine the most useful complaint route.
