PIP after pregnancy disclosure: document the sequence first
Your reviews were positive until you told the company you were pregnant. A few days later, a PIP arrives, targets change and HR suggests resigning to receive an experience letter. Instead of signing under pressure or relying on a verbal argument, preserve the records and respond using the maternity and employment rules applicable to your case.
A PIP after pregnancy disclosure is assessed through its actual reasons, timing, maternity absence, employment status and applicable law. Pregnancy does not automatically invalidate every performance review. Equally, calling an action a PIP or restructuring does not make deprivation of maternity rights lawful.
The current law: do not rely only on old section numbers
Government information states that the labour codes came into force on 21 November 2025. Chapter VI of the Code on Social Security, 2020 is relevant to the current maternity framework. Older articles cite Sections 6 and 12 of the Maternity Benefit Act, 1961. For current events, do not rely exclusively on those citations; earlier cases may require review of repeal, savings and applicable rules.
The Social Security Code addresses maternity notice in Section 62 and dismissal protection in Section 68. A notice supports documentation and the claim process; it does not automatically cancel every PIP.
The timing can raise a concern but is not conclusive alone. Earlier documented performance problems, a genuine closure and adverse action concerning protected leave present different facts. Reinstatement or prosecution cannot be guaranteed in every case.
Eligibility, probation and the ESI distinction
Identify which maternity route covers the establishment and your employment. Covered factories, mines and plantations and the applicable shop/establishment category have specific conditions; the ordinary shop/establishment threshold of ten or more employees is relevant. A small organisation, government service, agency arrangement or consultancy can require a separate review. A job title alone does not decide coverage.
The government maternity overview describes the qualifying requirement of at least 80 days’ work in the preceding 12 months. The ordinary maximum is 26 weeks, with different periods in circumstances such as having two or more surviving children. Do not treat the company’s leave policy as the only source of entitlement.
Probation alone does not erase maternity rights. Check joining dates, qualifying service and employment terms. It is also inaccurate to claim that a probationer can never be dismissed. Fixed-term expiry, dismissal and a pressured resignation are distinct events; expiry should not automatically be assumed to extinguish every maternity payment due.
For an ESI-insured woman, benefit qualification and the claim route differ. Verify the ESI number, contribution history and eligibility with ESIC before using an employer-paid Chapter VI calculation. The Social Security (Central) Rules, 2026 contain separate ESI and maternity provisions.
Send a written notice and answer the PIP
Inform HR or the authorised employer contact in writing about pregnancy and the expected delivery date. Supply necessary medical proof, proposed absence dates and prescribed claim particulars, and request acknowledgment. Applicable Central Rules provide Form XI and permit acceptance of an electronic/plain-paper application containing relevant details. A claim is not invalid merely because the specified form was not used.
Create a formal record after an informal conversation. Failure to give an earlier notice does not automatically destroy an otherwise-entitled maternity claim. Nevertheless, complete the appropriate documentation promptly. Share necessary proof through the relevant HR channel rather than broadcasting your full medical history.
A concise HR email to adapt
Subject: Maternity intimation and benefit process. I am notifying you of my pregnancy; the expected delivery date is [date]. Relevant medical proof is attached. My proposed maternity absence starts on [date]. Please confirm the applicable claim form, eligibility/benefit calculation and acknowledgment. For the PIP dated [date], please provide specific concerns, earlier feedback, measurable targets and the review process. Please ensure applicable maternity protections and absence requirements are respected.
This is an email example, not a declaration that a prescribed form can always be replaced. Choose dates according to eligibility and medical advice. You can send the maternity notice and PIP objection separately where clearer.
Do not ignore the PIP. Answer allegations factually, request achievable criteria and resources, and challenge incorrect dates or entries treating approved leave as failure. Pregnancy does not mean that no evaluation is possible. Where work or targets conflict with a medical restriction, request an appropriate adjustment with relevant evidence. Work from home is not an automatic entitlement in every case.

Preserve the evidence that matters
- Appointment letter, probation/fixed-term terms, salary slips, attendance and applicable policy.
- Pregnancy intimation, acknowledgment, leave request and approval.
- Earlier reviews, appraisals, awards and documented concerns.
- PIP dates, targets, deadlines, feedback, changed duties and your response.
- Genuine messages concerning resignation pressure, benefit denial or pregnancy-related comments.
- The termination order, reasons, effective date, leave/delivery timeline and benefit calculation.
Make a dated chronology linking reviews, disclosure and subsequent action. Preserve specific records rather than relying entirely on memory. After a meeting, send a brief confirmation of your understanding and invite corrections.
Keep your own employment records lawfully. Do not copy customer information, source code, business secrets or other employees’ medical records to a personal account. Covert recording is not a universal solution; legality depends on context. If access is removed, request your relevant records through a formal channel.
Where to challenge pressure, benefit denial or termination
Ask HR or the internal grievance channel for specific relief: reasons, correction of the PIP, maternity benefits, absence protection or review of termination. Keep acknowledgment. Waiting for an internal response does not replace a statutory appeal deadline.
Withheld Chapter VI payments or dismissal connected with protected absence can engage the Inspector-cum-Facilitator complaint route. The applicable Section 68(2) appeal concerning dismissal or benefit deprivation has a 60-day period from communication. Section 72(3) provides a separate 30-day appeal against the relevant Inspector’s order. A routine HR email is not a filed statutory appeal.
Identify Central/State jurisdiction and the notified competent authority. Ask the local labour office for the correct officer, form and filing method instead of assuming any generic Labour Commissioner email completes the process. Applicable Central Rules provide Form XII for a Section 68 appeal. Attach the order, chronology, evidence, qualification details and requested relief.
A pre-leave PIP or dismissal may require an employment remedy alongside maternity relief. Industrial dispute eligibility depends on actual duties and the applicable definition; every manager or consultant does not have the same labour-court route. A separate sexual harassment event can engage POSH procedures, but every pregnancy-related grievance is not a POSH complaint.
Review the effect of a resignation, full-and-final document or settlement before consenting. Receiving or reading a form does not require immediate acceptance. Request a copy and time for independent review if pressured to sign. One complaint does not guarantee immediate prosecution, reinstatement or fixed compensation. Eligible employees can seek NALSA/local legal aid; the helpline is 15100.
A brief complaint outline
I have worked at [employer/address] since [joining date] as [role]. I gave pregnancy notice on [date]; expected delivery is [date]. On [date], [PIP/termination/benefit denial] occurred. The orders and chronology are attached. Please examine applicable coverage, maternity entitlement and employment protection and grant appropriate relief. Kindly confirm the correct jurisdiction/form and acknowledge receipt.
For a separate notice-pay or relieving-letter dispute, see our notice period and job exit guide. Review the maternity claim separately alongside it.
Frequently asked questions
Does a maternity notice automatically invalidate every PIP?
No. Examine the actual reasons and effect on protected absence and benefits.
Does probation exclude maternity benefits?
Probation alone is not decisive. Review coverage and qualifying service.
Can a restructuring label eliminate maternity dues?
The label alone does not remove statutory entitlement. Review the facts, eligibility and order.
Does missing an earlier written notice destroy the entire claim?
Not automatically where otherwise entitled; complete documentation and the appropriate process promptly.
Should I resign first and complain later?
A pressured resignation can complicate the dispute. Record your objection and obtain independent advice first.
Our advice
Send written maternity intimation, preserve reviews, respond factually to the PIP and protect the deadline for the correct remedy. Use the notified labour authority or legal aid where needed. Disclosure is an important record, not automatic immunity from every employment action.
