Child passport without father’s consent: identify your circumstances first
Your child lives with you and you handle school and daily expenses, but the father refuses to sign the passport application or cannot be contacted. That does not mean a passport is permanently impossible. Passport Seva provides an Annexure C route for cases where one parent has not consented. The reason, supporting records and custody situation must be understood together.
This guide concerns ordinary fresh/reissue applications for Indian minors within India. Overseas applications, adoption, guardianship and citizenship questions can require different records. Missing consent, removing a parent’s name and permission to take a child abroad are separate issues. One declaration does not automatically resolve all three or override an existing order.
Immediate checklist
- Collect birth, address and relevant parent/guardian records.
- Identify whether you are separated, divorced, in pending proceedings or dealing with a deceased parent.
- Read all custody, visitation and passport/travel orders.
- Use the current official Annexure C/D and Document Advisor.
- Prepare a truthful non-consent explanation with available evidence.

What Annexure C does and which form to use
The current Passport Seva annexures page identifies Annexure C for a minor where one parent has not given consent. Annexure D is a separate minor parent/guardian declaration. Older articles may use historical G/H labels; obtain today’s prescribed documents from the official portal. A generic NOC letter is not a replacement for the prescribed declaration.
The official Annexure C is on plain paper and includes reasons, parent particulars and declarations concerning care, physical custody and truthfulness. Do not sign a custody statement that is inaccurate. In a shared or disputed arrangement, seek written guidance instead of improvising changes to a prescribed form. False declarations can have serious consequences.
We link the official PDF rather than inventing a substitute legal affidavit. Download the entire current version and read it before completing it. If additional attestation is requested, clarify the applicable requirement. Buying stamp paper or paying an agent to obtain a purported NOC is not evidence that the process is legally necessary.
Separated mothers, divorce and disputed custody
Absence of a divorce decree does not exclude every single-parent application. Official manual guidance provides a route for a separated parent through Annexure C. Separation and legal divorce are different statuses. Answer the application questions accurately rather than declaring yourself divorced simply to fit a convenient category.
Where proceedings or orders exist, provide them. Sole custody, visitation and a restriction on passport issuance or travel have different implications. The declaration distinguishes circumstances and supporting records; do not conceal an order by merely saying the other parent lives elsewhere. Seek appropriate court clarification or modification if an existing restriction must be addressed.
A refusal may be supported by relevant messages, emails or letters. If whereabouts are genuinely unknown, describe that fact with available evidence. Do not simultaneously claim the parent is untraceable and that they personally refused yesterday without explaining the chronology. The issuing authority assesses the records, and a disputed account can require further examination.
Prepare the file for the actual category
- Unwed single mother: check the special guidance and parent-name entries.
- Separated, not divorced: explain the status and available non-consent evidence.
- Divorced: provide the complete decree and custody/visitation conditions.
- Pending case: provide the petition and all relevant orders.
- Other parent deceased: obtain the death certificate and category-specific checklist.
Can lack of consent also remove the father’s name?
Consent and parent-name entry are different questions. Official special-minor guidance distinguishes children of married parents from unwed single-parent cases. Lack of consent alone should not be presented as an automatic right to leave a name blank or substitute a stepfather’s name. Confirm the documentary basis for the particular request.
List any mismatch across the birth certificate, school record and previous passport before applying. Do not alter a birth record inaccurately merely to simplify a passport application. Make a name-exclusion/change request explicit and ask which rule applies. A married parent should not describe the situation as unwed for convenience.
FACT: missing NOC is not automatically a final bar
In Jasmine Jangra v. Union of India, W.P.(C) 6124/2025, decided on 21 May 2026, the Delhi High Court held that absence of the father’s NOC/signature alone was not a statutory refusal ground in that matter and explained the prescribed declaration. Its thirty-day direction concerned that child; it is not a universal processing promise for every applicant.
The practical point is to request reasoned consideration under Annexure C rather than accept a bare demand for the father’s signature as the end of the process. Citizenship, identity, existing orders and other legal obstacles still need examination. The authority may undertake verification or contact the other parent. An objection does not automatically decide every case in either direction.
Documents, online application and the PSK visit
Start with the official Document Advisor for minor status, fresh/reissue and your circumstances. Birth and address proof form the core file; an accepted address document in a parent’s name may be used for a minor. Where parents hold passports, keep relevant originals/copies and particulars as directed by the applicable checklist.
Add custody, death or guardianship papers and evidence concerning missing consent as applicable. A generic address declaration is not automatically interchangeable with every accepted address proof. Confirm which purpose each document serves instead of assuming school records, Aadhaar and a birth certificate answer the same requirement. Keep originals and self-attested copies organised.
- Use the official Passport Seva portal and select the correct fresh/reissue service.
- Enter the child’s and parent/guardian particulars accurately, including relevant court-related answers.
- Keep the ARN/application receipt and appointment details.
- Check the current official Fee Calculator rather than old blog amounts.
- Confirm child and applying-parent attendance requirements at PSK/POPSK.
- Record the file number, written objections and next follow-up step after the visit.
Official Tatkaal exclusions include Annexure C minor applications and certain single-parent categories. Do not assume an urgent trip makes the case eligible for guaranteed expedited issuance. Submit genuine education or medical urgency records and ask the authority about available procedure. Non-refundable travel bookings made before approval can create avoidable financial pressure.
Responding when the RPO asks only for father’s NOC
Request the specific document, clause or factual deficiency instead of arguing at the counter. Ask for a written explanation and applicable basis. A verbal objection does not establish whether the file is awaiting records, awaiting verification or formally refused. The appropriate next step changes with that status.
Covering representation for consideration of the application
To: Regional Passport Officer, [region] Subject: Minor passport application [ARN/File No.] – request for consideration where one parent’s consent is unavailable Sir/Madam, I am [name], the mother/father/legal guardian of minor [name, DOB]. The child is in [accurate care/custody circumstances]. The other parent’s consent is unavailable because [truthful reason]. I enclose the current prescribed declaration and applicable records. Court proceedings/orders: [complete accurate position with relevant copies]. Please consider the application under official Annexure C and applicable single-parent/minor guidance. If any deficiency or other legal requirement remains, kindly specify it and the relevant provision in writing. This request does not purport to modify a custody, visitation or travel order. Name, secure contact, date Attachments: receipt, birth/address records, declaration and relevant supporting records
Follow-up on a pending objection
Subject: File [number] – written status of pending minor passport objection Sir/Madam, The application was submitted on [date]. On [date], the objection communicated was [exact issue]. I supplied [documents/representation] on [date], acknowledged under [reference]. Please identify any remaining specific deficiency, the pending process and the action required from me. If a decision has been made, please supply the reasoned written order/communication. Name, contact, date; relevant acknowledgments
These representations are not official Annexure C/D forms. Use Passport Seva grievance channels or a verified RPO contact, and avoid publishing your child’s identity documents on social media. Preserve the service-request number. The National Call Centre, 1800-258-1800, can assist with process/status guidance, but a telephone assurance is not an issuance order.
Grievance, appeal and separate permission to travel
Answer a document deficiency with truthful clarification and supporting records. For a pending file, use official tracking and grievance follow-up. For formal refusal, obtain the written order and check the applicable statutory appeal procedure, deadline and fee. A grievance does not automatically suspend an appeal deadline; starting another application is not the correct answer to every refusal.
If an inappropriate consent-only obstacle persists, show the file to a lawyer or legal-aid provider to assess administrative remedies or High Court relief. Costs, timing and outcomes depend on the facts. A cited judgment does not cancel a custody order in your case. Preserve the application, correspondence, acknowledgments and exact reasons so the decision can be reviewed.
A passport is a travel/identity document, not automatic permission to relocate the child abroad or defeat visitation rights. Check family-court conditions, visa requirements, airline/border documentation and destination rules separately. Do not use the process to conceal facts or remove the child contrary to an operative restriction. When necessary, obtain the relevant permission before travel.
Advice
Clarify the custody and document timeline first. Explain missing consent, disclose relevant orders and request a specific written response. Keep the missing-NOC, parent-name and travel-permission issues separate. An organised file and calm written follow-up do not guarantee approval, but make a vague objection easier to address.
- Address declaration: check accepted passport documents separately
- Name change affidavit: a separate procedure
