How to Take Back a House Gifted to a Son: Senior Citizens, Section 23 and Tribunal Process

How to Take Back a House Gifted to a Son: Senior Citizens, Section 23 and Tribunal Process

How to take back a house gifted to a son: start with the records

Parents transferred a house trusting that they would be cared for. Now medicines, food or accommodation are being refused, or there is pressure to leave. “Registration means nothing can ever be done” is an incomplete answer. Section 23 may offer senior citizens a remedy, but not every transfer is automatically cancelled. Start with age, ownership, transfer documents and evidence of the maintenance condition.

Collect the complete registered deed, any accompanying undertaking and genuine records of neglect. Then identify the notified Maintenance Tribunal for the relevant area. Emotional allegations or a name in a revenue record alone do not establish the correct route. This guide explains practical preparation, the application and lawful follow-up.

Today’s checklist

  • Collect age/identity evidence and the earlier ownership records.
  • Obtain the complete registered gift/release/other transfer deed.
  • Separate any care/residence condition, undertaking and relevant genuine correspondence.
  • Create a dated record of unmet food, medicine, accommodation or support needs.
  • Ask the Tribunal/social-welfare office about jurisdiction, forms and acknowledgment.

When can section 23 help?

Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 provides a special remedy for an eligible senior citizen’s property transfer after the Act’s commencement. The central questions are whether transfer was conditional on providing basic amenities and physical needs, and whether the recipient refused or failed to provide them. If established, the competent Tribunal may declare the transfer void.

Under the Act, a senior citizen is an Indian citizen aged 60 or above. The transfer date, relevant state commencement and other eligibility questions need checking. A transfer to a son, daughter or another recipient is not decided solely by the relationship. A separate parental-maintenance route does not have identical requirements to property cancellation.

If the house remains in your name and someone was merely allowed to live there, cancelling a completed gift is a different issue. A will is also different from a lifetime completed transfer. Identify whether the document is a gift, release, sale, family settlement or something else before choosing a remedy.

What if the care condition is not clearly written?

Read the entire deed, not only the “love and affection” line. Does it address maintenance, residence, life interest or expenses? Is there a signed undertaking or another genuine contemporaneous record? Explain the actual condition and evidence supporting it. Establishing a condition is different from merely establishing that you are the recipient’s parent.

In Urmila Dixit v. Sunil Sharan Dixit, 2025 INSC 20, the Supreme Court considered the gift deed and accompanying care-related documents and upheld relief cancelling the gift in the circumstances of neglect. The judgment also explained the Sudesh Chhikara requirements of a maintenance condition and failure/refusal to fulfil it.

Avoid both blanket statements: that a missing clause always defeats a case, or that every neglected parent can automatically recover every gift. The actual condition, available evidence and application of the judgment to your facts matter. Never alter an old document or create a backdated undertaking to supply a missing condition.

Ancestral, self-acquired and jointly owned property differ

A house gifted to a child is not necessarily ancestral property. A home you purchased, an inherited share and joint/ancestral property may raise different ownership questions. Identify the rights you had at transfer, other co-owners/coparceners and the particular share covered by the deed.

A co-owner cannot simply treat the entire property as exclusively theirs and seek return of everyone else’s shares. Mutation alone should not be treated as the original title or a conclusive assessment of a registered transfer. If no transfer occurred, or there is a separate title/partition dispute, another route may be needed. Section 23 is not a universal answer to every family property disagreement.

Disclose any onward sale, mortgage or pending litigation. Other people’s interests and the proper parties may need consideration. If a sale is imminent, obtain advice about available interim protection using the actual records. Filing a complaint does not automatically stop registration or dealings in the property.

Prepare genuine evidence of the condition and neglect

  • The deed, registration details, property identification and relevant ownership chain/share.
  • Genuine maintenance/residence conditions and accompanying undertaking, if available.
  • Medical, medicine and essential-expense records, plus evidence of requests or refusal.
  • Dated facts about threatened eviction, denied entry or other relevant conduct.
  • Relevant messages, previous representations, police/helpline acknowledgments and real witnesses.
  • Your actual needs, income/support and present accommodation.

Prepare a one-page chronology: when transfer occurred, the condition, when difficulties began and what assistance you requested. Number the annexures. Keep originals safe and ask about copy verification. Do not sign blank papers or a document described as a mere formality without understanding it.

Family disagreements and refusal of basic needs are not identical. Instead of saying “my son is bad”, explain the particular medicine, accommodation or support refused and when it occurred. Disclose any support the recipient is in fact providing. The Tribunal will consider the response and circumstances; a truthful account matters more than exaggerated accusations.

How to approach the Maintenance Tribunal/SDM

Identify the notified Tribunal under the relevant state arrangement. In many places an SDM or sub-divisional officer presides, but not every SDM automatically has authority to cancel every transfer. Ask the district social-welfare/maintenance office or collectorate help desk for the correct jurisdiction, address, current form and annexure requirements.

State the applicant/respondent identities, age, addresses, property, transfer date, actual condition, breach and relief requested. Obtain a diary/application number. If directed elsewhere, ask for the jurisdictional reason and appropriate office. Keep hearing dates and arrange assistance or representation permitted by the applicable procedure.

Ask about filing personally and assistance through a Maintenance Officer. Legal advice can help review documents. Who may represent a party at the hearing must be checked against applicable local rules and judicial directions; avoid universal claims about lawyers never being needed or permitted. Ask the District Legal Services Authority about assistance if eligible.

Guiding outline for a section 23 application

To: The competent Maintenance Tribunal
Subject: Application for relief concerning property transfer under section 23

Applicant: [name, age, address, contact]
Respondent: [name, relationship, address]
1. I held [accurate property/right details]. On [date], by document/deed number ___, I transferred [share].
2. The actual maintenance condition connected with the transfer was ___. Supporting evidence: annexure ___.
3. Refusal/failure occurred as follows: [dated facts]. Evidence: annexure ___.
4. My present circumstances and essential needs are ___.
5. Please examine eligibility and facts and grant appropriate relief declaring the relevant transfer void and any permitted possession/other relief. If necessary and lawful, consider appropriate interim protection.
Other proceedings/onward transfers/mortgages: ___.
Verification: These details are true to my knowledge.
Date/signature/annexure list: ___

This is not a universal ready-to-file pleading. Adapt it to local forms, verification, affidavits, parties and permissible relief. If you cannot support a maintenance condition, do not invent one to fit the template. Have the other available options examined.

Possession after an order, and safety before the decision

Cancellation and actual restoration of possession may involve separate implementation steps. Urmila Dixit also discussed restoration of possession connected with section 23 relief. Obtain the order copy, identify the deed/share affected and understand compliance. Use the appropriate official process for registration/revenue-record changes.

Do not break locks, remove belongings or disconnect utilities as a substitute for lawful enforcement. Check the actual effect of an appeal, stay or other proceedings. If an order is not complied with, seek written assistance through the Tribunal/competent authority’s enforcement process and retain references.

Do not wait for the property case to conclude if there is violence or an immediate threat. Use 112 for emergencies and Elderline 14567 for senior-citizen information/guidance and support. Local availability and response can vary, and a helpline does not cancel deeds. Arrange temporary safe accommodation, medicines and trusted support separately.

Advice

Separate the requests for property relief, maintenance and safety. Protect your banking access, pension, identification and original records. Avoid agents demanding advance payments for guaranteed outcomes. If considering settlement, understand and record residence, expense obligations and lawful next steps if commitments are not honoured. Do not rush into another transfer.

FAQ: taking back a gifted house

Can every registered gift be cancelled?

No. Eligibility, a maintenance condition and refusal/failure, together with the particular facts, must be established for section 23 relief.

Can only a son be the respondent?

No. Identify the actual transferee and proper parties. The relationship alone does not decide the result.

Does filing put the house back in my name immediately?

No. Examination, notice/hearing, an order and the applicable implementation/record process are required.

What if the house is still in my name?

First examine actual ownership and possession. Transfer cancellation may not be the relevant route; protection or possession remedies may differ.

How long will the decision take?

There is no guaranteed period covering every property-cancellation case. Procedure, notice, evidence and pending proceedings affect the timeline.

Disclaimer: General legal information for India. State rules, documents and facts affect relief. Fact-check date: 13 October 2026. An application template does not guarantee cancellation or possession.
